A CITIZEN who watched a cop illegally park, then walk into a Chinese restaurant to wait for his food, has issued the officer a series of citizen-initiated parking violations.

Eric Bryant says he was sitting in the SanSai Japanese Grill on NW 21st and Hoyt on March 7 when he witnessed Officer Chad Stensgaard pull up and park his patrol car illegally, next to a "No Parking" sign.

Stensgaard walked into the restaurant wearing his police uniform, but did not make any arrests or citations. Instead, he turned his attention to the basketball game on television, according to Bryant. When Bryant asked Stensgaard about his vehicle, Stensgaard allegedly acknowledged being in a no-parking zone but asked Bryant, "If someone broke into your house, would you rather have the police be able to park in front of your house or have to park three blocks away and walk there?"

Bryant returned to his seat, and says shortly afterward he watched a restaurant employee hand the officer a plastic bag before he left. Unfortunately for Officer Stensgaard, Bryant had recently passed the Oregon bar exam, and decided to pursue
the matter further.

"If he had acknowledged and corrected his error, we could have avoided this whole thing," says Bryant. "But instead, he kept watching basketball and told me he wasn't doing anything wrong."

Now, using ORS 153.058, Bryant—as a private citizen—has initiated violation proceedings against Officer Stensgaard. Bryant alleges Stensgaard was in violation of state statutes on illegal parking, illegal stopping, obeying parking restrictions on state highways, and illegal operation of an emergency vehicle or ambulance—the violations carry fines totaling $540.

Officer Stensgaard has received a Multnomah County summons to appear in traffic court on May 23. Meanwhile Bryant denies he is just stirring up trouble.

"Citizens should be concerned that he used his status as an officer of the law as justification for breaking the law," he says.

Stensgaard declined comment through the cops' office of public information.



Oregon statutes

153.058 Initiation of violation proceeding by private party. (1) A person other than an enforcement officer may commence a violation proceeding by filing a complaint with a court that has jurisdiction over the alleged violation. The filing of the complaint is subject to ORS 153.048. The complaint shall be entered by the court in the court record.

(2) A complaint under this section must contain:

(a) The name of the court, the name and address of the person bringing the action and the name and address of the defendant.

(b) A statement or designation of the violation that can be readily understood by a person making a reasonable effort to do so and the date, time and place at which the violation is alleged to have occurred.

(c) A certificate signed by the complainant stating that the complainant believes that the named defendant committed the violation specifically identified in the complaint and that the complainant has reasonable grounds for that belief. A certificate conforming to this section shall be deemed equivalent of a sworn complaint. Complaints filed under this section are subject to the penalties provided in ORS 153.990.

(3) Upon the filing of a complaint under this section, the court shall cause a summons to be delivered to the defendant and shall deliver a copy of the complaint to the district attorney for the county in which the complaint is filed. The court may require any enforcement officer to serve the summons.

(4) If the complaint does not conform to the requirements of this section, the court shall set it aside upon motion of the defendant made before the entry of a plea. A pretrial ruling on a motion to set aside may be appealed by the state.

(5) A court may, acting in its sole discretion, amend a complaint filed under the provisions of this section.

(6) A court shall dismiss a complaint filed under this section upon the motion of the district attorney for the county or of the city attorney for a city if:

(a) The district attorney or city attorney has brought a proceeding against the defendant named in the complaint or intends to bring a proceeding against the defendant named in the complaint; and

(b) The proceeding is brought by the district attorney or city attorney by reason of the same conduct alleged in the complaint.

(7) Any political subdivision of this state may require by ordinance that violation proceedings for the purpose of enforcing the charter or ordinances of the political subdivision may not be commenced in the manner provided by this section and that those proceedings may be commenced only by enforcement officers.

(8) A person other than an enforcement officer may commence a violation proceeding under this section only for:

(a) Boating violations under ORS chapter 830, or any violation of rules adopted pursuant to ORS chapter 830 if the violation constitutes an offense;

(b) Traffic violations under ORS chapters 801 to 826, or any violation of rules adopted pursuant to those chapters if the violation constitutes an offense;

(c) Violations under the wildlife laws, as described in ORS 496.002, or any violation of rules adopted pursuant to those laws if the violation constitutes an offense;

(d) Violations under the commercial fishing laws, as described in ORS 506.001, or any violation of rules adopted pursuant to those laws if the violation constitutes an offense; or

(e) Violations of ORS 618.121 to 618.161, and violation of rules adopted pursuant to those laws if the violation constitutes an offense. [1999 c.1051 §11]



Tennessee Code §40-7-109. Arrest by private person - Grounds

(a) A private person may arrest another:

(1) For a public offense committed in the arresting person's presence;

(2) When the person arrested has committed a felony, although not in the arresting person's presence; or

(3) When a felony has been committed, and the arresting person has reasonable cause to believe that the person arrested committed it.

Every single Metropolitan police officer will be 'microchipped' so top brass can monitor their movements on a Big Brother style tracking scheme, it can be revealed today.

According to respected industry magazine Police Review, the plan - which affects all 31,000 serving officers in the Met, including Sir Ian Blair - is set to replace the unreliable Airwave radio system currently used to help monitor officer's movements.

The new electronic tracking device - called the Automated Personal Location System (APLS) - means that officers will never be out of range of supervising officers.

But many serving officers fear being turned into "Robocops" - controlled by bosses who have not been out on the beat in years.

According to service providers Telent, the new technology 'will enable operators in the Service's operations centres to identify the location of each police officer' at any time they are on duty - whether overground or underground.

Although police chiefs say the new technology is about 'improving officer safety' and reacting to incidents more quickly, many rank and file believe it is just a Big Brother style system to keep tabs on them and make sure they don't 'doze off on duty'.

Some officers are concerned that the system - which will be able to pinpoint any of the 31,000 officers in the Met to within a few feet of their location - will put a complete end to community policing and leave officers purely at the beck and call of control room staff rather than reacting to members of the public on the ground.

Pete Smyth, chairman of the Met Police Federation, said: "This could be very good for officers' safety but it could also involve an element of Big Brother.

"We need to look at it very carefully."


Other officers, however, were more scathing, saying the new system - set to be implemented within the next few weeks - will turn them into 'Robocops' simply obeying instructions from above rather than using their own judgement.

One officer, working in Peckham, south London, said: "They are keeping the exact workings of the system very hush-hush at the moment - although it will be similar to the way criminals are electronically tagged. There will not be any choice about wearing one.

"We depend on our own ability and local knowledge to react to situations accordingly.

"Obviously we need the back up and information from control, but a lot of us feel that we will simply be used as machines, or robots, to do what we are told with little or no chance to put in anything ourselves."

He added: "Most of us joined up so we could apply the law and think for ourselves, but if Sarge knows where we are every second of the day it just makes it difficult."

Another officer, who did not want to be named, said: "A lot of my time is spent speaking to people in cafes, parks or just wherever I'm approached. If I feel I've got my chief breathing down my neck to make another arrest I won't feel I'm doing my job properly."

The system is one of the largest of its kind in the world, according to Telent, the company behind the technology, although neither the Met nor Telent would provide Police Review with any more information about exactly how the system will work or what sort of devices officers will wear.

Nigel Lee, a workstream manager at the Met, said: "Safety is a primary concern for all police forces.

"The area served by our force covers 620 miles and knowing the location of our officers means that not only can we provision resource more quickly, but should an officer need assistance, we can get to them even more quickly."

Forces currently have the facility to track all their officers through GPS devices on their Airwave radio headsets, but this is subject to headsets being up to date and forces buying the back office systems to accompany them, according to Airwave.

Steve Rands, health and safety head for the Met Police Federation, told Police Review: "This is so that we know where officers are. Let us say that when voice distortion or sound quality over the radio is lost, if you cannot hear where that officer telling you where he is, you can still pinpoint his exact position by global positioning system.

"If he needs help but you cannot hear him for whatever reason, APLS will say where he is."

It can sometimes be forgotten that computer viruses are not a Windows-only problem, but the recent announcement that RFID chips may be vulnerable to viral attack underscores the threat that malicious code can pose to all types of systems. A group of researchers at Vrije Universiteit in Amsterdam have just presented a paper (PDF) at the Pervasive Computing and Communications Conference in Pisa, Italy that demonstrates just how such a virus might work.

Consider a malicious traveler who attaches a tiny RFID tag, pre-initialized with a virus, to a random person's suitcase before he checks it in. When the baggage-handling system's RFID reader scans the suitcase at a Y-junction in the conveyor-belt system to determine where to route it, the tag responds with the RFID virus, which could infect the airport's baggage database. Then, all RFID tags produced as new passengers check in later in the day may also be infected. If any of these infected bags transit a hub, they will be rescanned there, thus infecting a different airport. Within a day, hundreds of airport databases all over the world could be infected. Merely infecting other tags is the most benign case. An RFID virus could also carry a payload that did other damage to the database, for example, helping drug smugglers or terrorists hide their baggage from airline and government officials, or intentionally sending baggage destined for Alaska to Argentina to create chaos (e.g., as revenge for a recently fired airline employee)."

The UK's most profitable speed camera that has been sending £60 (US $120) tickets to vehicle owners at the rate of 2000 per day may now be forced to issue refunds. The device, located on the southbound M11 at Woodford, Essex is situated at the point where the speed limit suddenly drops from 70 MPH to 50 MPH. Last month motorist Simon Grills forced the Crown Prosecution Service to drop his speed camera ticket after he proved the signs warning of the speed change were effectively invisible at night. Grills produced evidence showing the lights meant to illuminate the signs had been burned out since November 18, 2005. Grills had spent months fighting the ticket he received in September 2006.

"When I got flashed I couldn't work out how I'd missed the sign," Grills told the Sunday Mirror newspaper. "Then it clicked -- it's simply not visible at night."

The Mirror estimated that since the bulbs burned out at least 214,000 drivers had been trapped by the camera at night, generating £13 million (US $26 million) in revenue.

The speed camera in question has been the center of controversy since it was first installed, inspiring one group to take its disagreement outside the courtroom. Captain Gatso, the leader of the anti-photo enforcement vigilante organization known as Motorists Against Detection (MAD), cited the M11 camera as evidence that officials were engaging in "fleecing, not policing" and proceeded to use a heavy truck to yank the device off of its mounting in late 2002.

"We have spoken to numerous police officers and emergency service personnel countrywide and they agree that the majority of speed cameras are sited for revenue, not safety, and in a lot of cases they just impede general progress," Captain Gatso said in a statement at the time.

This is perhaps one of the most kooky and creepy Security State tactics that I have come across: the EMD safety bracelet, which is being billed as the "last line of defence." A company called Lamperd Firearm Training Systems is trying to commercialize this item as an "airline security product." The company’s video that hawks this device talks about the current facial recognition system called biometrics, where cameras capture photos of people and compare those images to the images of "terrorists" in its "terrorist" database. No matter how sophisticated this technology, it can all too often allow a terrorist on board a plane, and, this technology can also have the effect of creating airport bottlenecks. Ahem. The solution? The "viable, workable answer" is an electronic ID bracelet. This bracelet will replace the need for a ticket and contain all necessary information about the person, and as a bonus, it can allow the passenger to be tracked through the terminal. Crew members would be empowered with radio frequency transmitters to subdue "hijackers." The technology will override a person’s central nervous system and zap them down quicker than you can say "Homeland Security." The company assures us that being dragged through the bracelet process is a "small inconvenience in order to assure your safe arrival." In fact, its studies show that most people would "happily opt" for wearing the bracelet to "insure their own security."

Upon activation of the electric shock device, through receipt of an activating signal from the selectively operable remote control means, the passenger wearing that particular bracelet receives the disabling electrical shock from the electric shock device. Accordingly, the passenger becomes incapacitated for a few seconds or perhaps a few minutes, during which time the passenger can be fully subdued and handcuffed, if necessary. Depending on the type of transmission medium used to send the activating signal, other passengers may also become temporarily incapacitated, which is undesirable and unfortunate, but may be unavoidable.

Lamperd even posts a series of letters on its website showing interest in the product for use "outside of airport security," which, of course, is the real reason for the product. Why it can be used for border control to subdue illegal aliens or by local law enforcement agencies to control the "criminal element!"
